Do not wait any longer!

The State Department issued the priority dates to be used during January 2008. These dates present an illusion to those who do not know the 'frequency' the Department of State has been giving legal residences for the past 7 years. To illustrate, I used the analysis prepared by the legal team of the International Immigrants Foundation for determining the actual delays. Do not exist typographical errors! We have compared the granting of legal status during January 2008 compared to October 2000 to establish the current delay. Spouses, minors and parents of citizens have only administrative delays...

Illegal Entry

IWhile the majority of the families are preparing to share the holidays together, Maria, a Salvadorian immigrant, has a very serious problem…. She does not know what happened to her brother who supposedly was going to cross the border and join her to celebrate the holidays in the United States. In preparation for this holiday season, the American and Mexican Immigration Authorities have strengthened their aggressive efforts to restrain the illegal immigration, thus preventing the increase of over 200 immigrants...

Are you thinking of leaving the country?

As Christmas approaches, thousands of immigrants with pending residency applications leave the country to visit their loved ones without considering the consequences.
"Everyone who is in the process of residence must obtain a permit of re-entry before leaving the United States"; this has been spread by our media trying to keep our community informed. These members of the media do not know they are providing partial information that does not apply to everyone, and that their recommendations will become the worst nightmare for those that follow it without professional advice...

Day of the Indispensables

It is interesting to point out that in the 21st century and in the Country that is the symbol of liberty, more than 12 million human beings are part of the largest illegal population  in the world. In this period that we begin the Christmas parties with Thanksgiving, we forget that the pilgrims who came to this country were immigrants. The United States, the country with the most cultural and religious diversity,  established Thanksgiving as the national and spiritual celebration. In this time, the country remembers the spirit of those pilgrims who escaped religious persecution from England...

Should I Start or Wait?

Juan Manuel Benítez, in one of his controversial programs of “Pure Politics of New York 1 News, questioned the possibility for an undocumented immigrant to begin a residency application under current laws. Juan is not the only one who thinks this way, many other lawyers agree, such as Alma Rosa Nieto of Telemundo who says “Do not submit your residency application without 245i.
In the name of the legal division of the International Immigrants Foundation, legalizing people for more than 35 years, I recommend that you begin your application now. So, who should you believe? I will explain and you will see the issue clearly...

Punishment without a reason

Every time that we talk about the 12 million undocumented immigrants and the new immigration policies, the political hypocrisy begins again, seen in the inability to execute current law.On the one hand we have laws that require governments to proceed in one manner, and on the other, we have state and local decisions that act on the contrary, which is very confusing.

The Economy and its Effect

We live in a society with 302 million people, but that depends on only 50% of the population. The United States of America is maintained by contribution only. 153 millions of citizens, permanent residents, and immigrants with format work permits form the labor market. With an actual inflation of 1.93 percent; an unemployment rate of 4.7 % and an increase of labor by more than 100,000 of monthly employees. Considering all of this, motivated by the high cost of labor, all of the businesses have concentrated on maintaining maximum productivity with the least number of employees to show gain for their investors... .

The Decision of a Real Leader

In the last few years, thousands of undocumented immigrants have had to take chances by driving without a license in order to survive. As a consequence, the percentage of accidents without insurance has increased, and immigrants disappeared from the scene of an accident and that cost was transferred to each one of us who also drives.

The decision of Governor Elliot Spitzer to give drivers’ licenses to undocumented immigrants will not only help New York reduce insurance rates and promote safety on our highways and in the nation, but will also promote economic development. More than 500,000 immigrants, who live in the state of New York, buy or rent houses in remote areas where they need an automobile to get to work, to buy food, to take their children to school, in other words to survive, need to obtain a driver’s license to be able to move freely and legally.....

What can we learn from Arellano?

Immigrants like Arellano leave their mark on history! Elvira motivated us to reconsider what happens to an immigrant family who has a U.S. citizen son who is separated as a result of his parent’s deportation. More than 30 years have passed since September 30th, 1976, the last day that immigrants could obtain their residency from giving birth to a citizen child.

If you are in the process of legalization you should pay constant attention to the changes in the granting of residency cases, because it will determine what you should accomplish in the next 30 days.Every month the Department of State of the United States reports who can obtain legality or permanent residents according to their priority date. The priority date is the day that the government received your residence application or your offer of employment.

After the 16th of July, the Department of Labor’s new regulations begin in full force, with immediate effects on our community. The new regulations require that the employer pay all of the professional costs of the preparation, filing, and processing of a Labor Certification, and strictly prohibits that the employer’s request the foreign worker to pay the cost for the processing of the offer.

Many immigrants, without thinking, continue to submit themselves to the illusion of a lifetime wait for lack of knowledge or due to the faulty advice of legal professionals who have not carefully analyzed the Department of State report. This analysis has been carefully prepared to determine the real wait time for immigrant petitions. There are no typological errors! We have compared the residency grants from this month with those from October of 2000 to establish the actual wait time.
