Fraud
(part 1)

Due to the high percentage of fraudulent cases, the Immigration Service has established and implemented a program to evaluate the integrity in the granting of residency and temporary visas. The last evaluation found that 33% of religious petitions are fraudulent. Even though, generally Immigration will consider the immigrant to be at fault, many times they are the ones who are victims of unscrupulous individual or organizations that take advantage of their naiveness. 

For this reason, before staring your case, you must have in mind all the aspects of the documents you’ll be providing to the government. Consider the five points established by the International Immigrants Foundation from 1973:

 

1.     The “Intention” of the relationship with the petitioner;

2.     The “Good faith” that must be demonstrated during the process;

3.     The “Admissibility” of the immigrant;

4.     The careful “Preparation” of the proper documentation; and

5.     The “Power of Discretion” that the Immigration officers have to deny or approve a case. 

For example, an ecclesiastical must demonstrate that is authorized by a denomination to conduct religious services, in accordance with the theological denomination. 

To clarify, during the last two years, he has to have been a member and employee of a church of the same denomination that is petitioning him. He must also show that his only intention to reside in the country is to work as a minister, or in a religious position. His wife and children can obtain their residency with you. The church must have IRS-501 (1) (c) (3) status, and must demonstrate that has the necessary economic means to pay a permanent salary that is over the poverty guidelines.  

Do your case with responsibility and remember that there’s always much more to analyze before formulating a legal strategy.
