The State Department issued the priority dates to be used during January 2008. These dates present an illusion to those who do not know the 'frequency' the Department of State has been giving legal residences for the past 7 years. To illustrate, I used the analysis prepared by the legal team of the International Immigrants Foundation for determining the actual delays. Do not exist typographical errors! We have compared the granting of legal status during January 2008 compared to October 2000 to establish the current delay. Spouses, minors and parents of citizens have only administrative delays.

But, unmarried and married sons and daughters of citizens: the priority date published by the Department of State is advancing only 10 days per month, creating a backlog of more than 20 years. If they are Mexicans, it has not moved even one day since the year 2000.  
Brothers and sisters of adult citizens, there is a delay between 11 and 14 years.  
Spouses and unmarried sons and daughters of permanent residents, there is a delay of 5 years and for Mexicans 7 years.

Unmarried adult’s sons and daughters of residents will wait more than 15 years and Mexicans more than 100 years.  
The Job Offer remains the fastest way for legalization... Therefore, those who have started their case before October 2002, with an occupation that requires more than two years of experience qualify to obtain legality and work permit if they are protected under section 245i or have remained legally in the country. Whoever possesses an approved job offer that does not require experience, can get start its legalization if the case was initiated prior October 2001?  
   
I f you have not started your legalization, begin your process of residence, regardless that the section 245i is closed. The position of the presidential candidates reflects the anti-immigrant sentiment of the American people. This reality shows that the new immigration law will not provide the opportunities that exist today. If processing your case takes a long time, diversify with a job offer.  
   
Remember that there is always much more to analyze before making a legal strategy.
