Thousands of Offers of Employment begun before April 30th, 2001 until the middle of 2005 will continue to wait for a final determination by the Department of Labor. To process more than 351,000 offers of employment that were overflowing, and by consequence, incapacitated the normal functions of the Division of Certification of Offers of the Department of Labor, they established the Center of Wait Eliminations. The mission of these centers will be to determine a new practical and fast way to deal with each pending case. But the practicality of these centers, reason for which they commit many errors that have caused thousands of work offers to be denied inappropriately, and by consequence, have produced even longer waits. Now, there is only a few more days, the 30th of September of 2007 is when the fiscal year ends; and in these Centers of Elimination of Waiting times, they should complete their mission and will have to close their doors.

Because thousands of offers of employment are still pending for final termination, these centers plan to finish all of these cases during the month of October. Therefore, if you have not received an answer from the Department of Labor since your case began, it’s very probably that your case will be unjustly denied and that you will have to investigate to immediately reopen the case.

This reality creates a series of questions such as: What do these closures mean?” What occurs with incomplete work offers? Could I appeal a denial?”

To clear up many of these questions; know what is necessary to approve an employment offer under the regulation know as PERM and to get advise about what to do immediately, I invite you to call (212) 302-2222 extension 300, in order to register and participate in a conference I will give about this topic in the International Immigrant building, located on 7 West 44th Street, Thursday October 4th at 3pm.

Eduardo Juárez is president of the International Immigrant Foundation. For assessment of questions concerning immigration, visit the International Immigrant Foundation in the Immigrant Building: 7 West 44 Street, Manhattan, N.Y. or call (212) 302-2222.
