Victims of naivety

Hundreds of thousands of undocumented immigrants have been residing in the United States for more than 10years without any record with immigration. Their arrivals were followed by establishing a family, having citizen children, working, paying taxes and, for many, having their own businesses. But this social and economic well-being is not complete without legal residence. Many immigrants fear involving their employer and try to solve their legality through a process known as “Cancellation of Removal”. As a result, they fall into a trap with no escape of their own desperation and lack of knowledge. Many others become victims of lawyers with alleged expertise in immigration and initiate this legal procedure that often transforms dreams into catastrophes.

The “Cancellation of Removal” is a legal process that is used to prevent an expulsion; if approved, it grants permanent residence to certain immigrants who are physically in the United States, specifically those who have lived here continuously for a period of more than 10 years, have shown good moral character during that time, have not been convicted of a criminal offense, and who can provide that their expulsion will result in an unusual, extreme and exceptional damage to their spouse, child or parent who is a permanent resident or citizen. This procedure also applies to victims of domestic violence.

It is important to note that although an immigrant could meet all the requirements that I have mentioned, he/she would have to surrender to immigration in order to commence a deportation proceeding against him/her, and one must understand that the “Cancellation of Removal” is granted or denied with full discretion of the immigration judge. If denied, the immigrant and his family run the risk of being expelled from the country.
