The Job Offer petition continues to be one of the quickest ways to obtain permanent residence. After the 16th of July, the Department of Labor’s new regulations begin in full force, with immediate effects on our community.
The new regulations require that the employer pay all of the professional costs of the preparation, filing, and processing of a Labor Certification, and strictly prohibits that the employer’s request the foreign worker to pay the cost for the processing of the offer. Therefore, don’t let a professional advise you to make special arrangements with your employer to pay for the cost of the application. That is illegal!
Furthermore, the new regulation permanently negates the possibility that an immigrant who has committed fraud can obtain another approved Labor Certification, which makes that person inadmissible for permanent residence. In our culture we expect that when we consult with a professional, they will tell us what to do in order to reach our objective. This is correct, as long as the exchange of information is truthful. But, if for some reason the occupation of the immigrant isn’t useful to the employer; many immigrants expect that a lawyer will help them prepare a favorable case. You have to be conscious that lying to the United States government is committing fraud! No lawyer will risk implicating themselves in a criminal act.
Therefore, be sure that you can show the required experience for the position that they are offering; read all of the prepared documents and sign with the understanding that you are personally responsible for everything that you submit to the government.

Remember that there is always more to analyze before forming a legal strategy.

*Edward Juarez Studied sociology, International laws, and specialized in immigration.  In 1973, established the International Immigrants Foundation, a non-profit institution created to educate, help, and defend immigrants.
