Punishment without a reason

Every time that we talk about the 12 million undocumented immigrants and the new immigration policies, the political hypocrisy begins again, seen in the inability to execute current law.

On the one hand we have laws that require governments to proceed in one manner, and on the other, we have state and local decisions that act on the contrary, which is very confusing.

For example, the law known as “Act of Public Wellbeing of 1996,” orders all government agencies, without exception, to report to Immigration any undocumented immigrants. On the contrary, in 1998 the IRS began to issue ITIN numbers to undocumented immigrants so that they may pay taxes. Another law signed in 1998 says that the dates obtained during the census can be utilized for national security, but, the Government has never used this information to deport undocumented immigrants.

On the other hand, millions of immigrants began their residency before and after April 30th, 2001, and even though they are still undocumented and Immigration is aware of this fact, they have not been placed in deportation proceedings.

The state license that Governor Spitzer would grant to undocumented immigrants of New York, would also be accessible for citizens who don’t have a license because they identify themselves with passports. Even though it is understandable that the state government will know the legal status of all of the legal and undocumented immigrants who obtain a license, it is important to note that this will not be different than the information that the I.R.S. uses for ITIN numbers, or the Immigration Service itself, neither of which has carried out mass deportations

Therefore, we should not be masochists without reason; we should support the heroic position of Governor Spitzer so that our undocumented brothers and sisters can enjoy the liberty to drive.

Encouraging the creation of more than 100,000 monthly employees, the immigrants are more indispensable than ever. Therefore, if you continue to be undocumented, look for professional advice and start your residency application for a job offer, without regard to whether or not 245i is closed. This is the best time!

Remember that there is always more to analyze before forming a legal strategy.
