Only until the next Monday, January 22nd, do
immigrants who began a traditional job offer
case, to change their cases to the process known
as “RIR” (Reduction in Recruitment). This
procedure, demonstrates that there are no
Americans workers who are available, qualified,
and eager to perform the work that is available
and that is being offered to an immigrant by the
lack of a legal worker.
In order to speed up the processing of thousands
of pending cases; the Department of Labor
established “Backlog Elimination Centers”. But
from their creation, these centers have denied
thousand of cases for little things and have
issued inconsistent decisions, like cases that
were converted to “RIR” when all the required
evidence was presented, but the Center had
started recruitment independently by the State
Employment Service offering the job. With this
opportunity, the Department of Labor guarantees
the applicant that they will consider all the
evidence that is provided in your “RIR” case,
without considering the procedures that started
independently to recruit national workers, you
will not lose your priority date, and will speed
up your final determination or approval.
In order to qualify, the employer must not have
received recruitment instructions to publish the
offered occupation, nor the document known as
“Notice of Findings” and the occupation must not
appear in the “listing B” (List of Occupations
for which the government considers that there
are workers available). Converting to “RIR” is
not automatic; you must ask the professional who
is assisting you and must be made with the
approval of the employer. If this conversion is
not requested, the proceeding will continue its
normal process. Don’t lose this chance!
Remember that there’s always much more to
analyze before formulating a legal strategy.

International Immigrants Foundation, a
non-profit institution created to educate, help,
and defend immigrants. In 1984, he established
the American Multicultural Coalition and the
International Cultures Celebration, conferences
in the United Nations, and the Parade and
Festival to promote intercultural relations.
With the goal of emphasizing the contributions
of immigrants,
Juarez established the “Immigrants
Building”
in 2003, located at
7 West 44th Street
in
Manhattan,
NYC, where the Foundation continues developing
programs that improve the quality of life for
immigrants. Currently, he is am active writer,
speaker, immigration columnist in El Diario la
Prensa, and host of The Immigrants Voice radio
and television programs.
